A lot of prefabs are sold in packs by creators. If you were to make money from something you created and it was obvious that you had taken textures, scenes or character designs directly from a single source without giving credit then it could become a legal issue.

For a non-profit creation, it depends. Fan-made creations can get away with it usually but "original works" that have ripped assets from another source can be taken down from the internet.

For a single concrete texture however it's highly doubtful anyone will cause a fuss unless it's REALLY distinctive somehow. Normally it all comes down to whether you profit from someone else's work.
